Child Victims Act Deadline Extended


Effective August 3, 2020, the New York Child Victims Act deadline has been extended one year to August 14, 2021.


Under recently signed legislation, the special filing deadline codified under Section 214-g of the New York Civil Practice Law & Rules has been extended. The special filing deadline was extended by one year. Thus, child abuse claims can now be filed pursuant to the Child Victims Act until August 14, 2021.


The Child Victims Act was signed into law in 2019 and originally gave individuals a one-year window to file claims previously barred by statute of limitations. Individuals can file claims under the Child Victims Act regardless of how long ago the alleged abuse occurred. It was originally set to expire on August 14, 2020. The statute only applies to claims where the individual was under the age of 18 at the time of the alleged abuse.
