Eviction Proceedings Suspended in New York

On August 12, 2020, the Chief Administrative Judge of the Courts issued an Administrative Order suspending residential and commercial eviction proceedings filed on or after March 16, 2020. No outstanding or new residential warrants of eviction may be executed prior to October 1, 2020.


This means that regardless of whether a tenant is delinquent on rent or whether a tenancy has ended and the tenant has refused to leave, the tenant cannot be evicted prior to October 1, 2020.


The Order does permit virtual settlement conferences if the petition has been filed and all parties have appeared with counsel.


In addition, this recent Administrative Order along with the prior Orders, provide special instruction for the filing and service of documents in eviction proceedings and content to be served with the Notice of Petition and Petition for Eviction.
